The Unemployment Insurance Bureau provides legal representation to the Department of Employment Security. The Bureau's responsibilities include representing the Department in administrative review cases from either benefit or tax decisions, prosecuting civil collections cases for both benefit overpayment and non-payment of unemployment insurance taxes, criminal prosecution of unemployment insurance fraud, representing the Department in bankruptcy cases and handling subpoenas or other official requests for information. The Bureau also represents the Department in bankruptcy cases in Illinois and around the country, primarily in: 1) filing Adversary Complaints to determine the non-dischargeability of a debt based on fraud overpayments, 2) responding to objections to claims filed by the Department or filing objections to confirmation of plans filed by debtors under Chapter 11 or 13 of the Bankruptcy Code; 3) ensuring post-petition compliance by debtors-in-possession by requiring the payment of all current taxes due under threat of liquidation; 4) defending complaints filed by debtors seeking a determination that the Department’s claim is dischargeable; and 5) defending the Department’s liens for unpaid contributions and procuring payment on secured claims. The position available requires significant bankruptcy litigation experience.
Qualifications:
We are primarily interested in individuals with at least two years of bankruptcy litigation experience.
Salary:
Salaries are commensurate with years of practice as a licensed attorney and start at $81,000. Candidates must be licensed by the State of Illinois at the time of application.
